Please read these Terms of Use carefully before using this Site and/or any services provided by Gaming Operator. By using the Site and/or any services provided by Gaming Operator, you agree to be bound by these Terms of Use. If you do not wish to be bound these Terms of Use you may not access or use the Site or any of the services provided by Gaming Operator.

 

General

Bonnier Gaming Malta Ltd, company registration number C 38582, 85 St John Street, Valletta, Malta (the “Gaming Operator”) provides bingo and casino games at the web-site www.bertil.com on the basis of the following gaming licenses (collectively the "Gaming License") issued by the Malta Lotteries and Gaming Authority (“LGA”).

- Bingo License Class 3 (LGA/CL3/254/2006)

- Casino License Class 1/4 (LGA/CL1/254/2008)

- Casino License Class 1/4 (LGA/CL1/728/2011)

 

The contractual relationship between you as a player (hereinafter “you” or the “Player”) and Gaming Operator, your use of the Site and the games, chat and other services provided by Gaming Operator is governed by these Terms of Use, the Gaming License and by the laws of Malta.

Playing at the Site is restricted to individuals of legal age as determined in the jurisdiction in which the Player resides, being an individual who has registered as a Player and who holds a Player’s account with Gaming Operator. Irrespective of the above and under no circumstances may a person register or play if he/she is under 18 years of age. Any funds deposited by or any winnings by any such person may be forfeited to the LGA. Please see also Section 7 below concerning restrictions for players from certain countries.

The Player understands and acknowledges that the games and the online community services provided on the Site are for entertainment purposes only. Any use of the Site for any other purposes or intention is strictly prohibited. You hereby acknowledge that your interest in the games and the community services provided by Gaming Operator is of a personal nature.

By registering on the Site you acknowledge and confirm your full acceptance of these Terms of Use and that you understand the rights, obligations, terms and conditions set forth herein. Should a Player not fully understand and agree to these Terms of Use, the Player is advised not to register on the Site and not to participate in any of Gaming Operator's events. The Terms of use are provided in English and a Swedish version. In case of any discrepancies between the different language versions, the English version shall prevail.

uSe of site and services

Registration

In order to use the services provided by Gaming Operator the Player must open an account (a “Player’s Account”). Only one Player’s Account is allowed per Player. Gaming Operator reserves the right to refuse any application for a Player’s Account.

The Player (including in this case any person applying to become a Player) must always provide valid, complete and correct information to Gaming Operator. You hereby acknowledge that if any of the information that you provide to Gaming Operator is false or incomplete, Gaming Operator will not accept your registration as a Player and should you already be registered as a Player with Gaming Operator, Gaming Operator is entitled and required to cancel your registration as a Player and close your Player’s Account. The Player is obligated to, upon request from the Gaming Operator, provide official documents in writing such as, for example, an addressed electricity bill, a bank account statement or any other written documentation which the Gaming Operator may find necessary in order to confirm the correctness of the information provided by the Player in connection with the registration or thereupon following verification procedures.

For the purposes of opening a Player’s account with Gaming Operator, the Player must complete the applicable online application form and provide Gaming Operator with at least the following details:

(a)      Name and address of the Player

(b)      Confirmation that the Player is at least eighteen years of age

(c)      A valid e-mail address belonging to the Player

Upon registration, the Player must select a user-name and a password. It is recommended that the password should include both letters and numbers, consisting of a minimum of six characters. Players must always log on using their user-name and password when accessing the Site and their Player’s Account. Players may not allow any person, other than themselves, to use their Player’s Account, to access and/or use any materials or information from the gaming system, to accept any prize, or to participate in any of the games.

The password should never be written-down or communicated to any other person, and should be changed on a regular basis. You are obliged to keep your account information, user-name and password secret and confidential and you are solely responsible for all use of the services through your user-name and password. In case you become aware of any known or suspected unauthorized use of your account or breaches of security you are required to immediately notify Gaming Operator hereof in order to suspend your Player’s Account. Any unauthorized use of your user-name or password shall be deemed as your use and you are responsible for all charges to your account until such notification is made to Gaming Operator. Should a Player give away, share, or lose its user-name and/or password, Gaming Operator shall not be liable for any loss or damage as a result thereof.

Player’s Account

 

A Player’s Account can have the following status:

Open:                   A Player’s Account can only be opened by the Player and will remain open as long as the account is not classified as Closed, Dormant or Inactive by Gaming Operator, or until Blocked or Terminated by the Player (“Open”).

Closed:                 A Player’s Account may be closed by Gaming Operator in accordance with these Terms of Use (“Closed”).

Inactive:                A Player's Account will automatically be classified as inactive in no activity or transaction has occurred on the Player's Account during a period of 90 days ("Inactive"). The Gaming Operator may charge an administrative fee for the costs incurred by the Gaming Operator for maintaining of the Inactive Account until the Player's Account is Closed or Terminated.

Dormant:               A Player's Account will automatically be classified as dormant in no activity or transaction has occurred on the Player's Account during a period of 30 months ("Dormant"). 

Blocked:               A Player’s Account may be blocked by the Player in accordance with Section 2.11 below when the Player wants a break from gaming (“Blocked”).

Terminated:           A Player’s Account may be terminated by the Player with the effect that a new Player’s Account cannot be opened until 30 days has elapsed from the day on which the Player terminated the Player’s Account (“Terminated”).

Deposits and wagers

Gaming Operator does not accept cash payments to the Player’s Account. Currently only the following payment methods are accepted:

(a)      VISA

(b)      Master Card

(c)      Eurocard

(d)      Neteller

(e)      Click2pay

Gaming Operator will not accept a wager from a Player unless there are sufficient funds in the Player’s account to cover the amount of the wager. Gaming Operator reserves the right to refuse or limit any wager. Gaming Operator will not grant a Player any credit and the Player may not use any amounts credited in error for the purpose of placing a wager. Neither deposits nor winnings are interest-bearing, i.e. the Player will not receive any interest on the balance on the Player’s account. Players are not entitled to make any transfers between Players or between different Player’s accounts.

Gaming Operator will monitor all wagers and account transactions. All wagers are binding for the Player when made. In the event of a game malfunction or use of the website in a way not intended by the design, all related wagers are considered null and void, and the Player’s account will be returned to its starting balance (the account balance prior to erroneous wagering activity). In case of an error referable to Gaming Operator's suppliers or other third parties, Section 10.3 below shall apply.

The minimum amount of any single transfer (deposit) to a Player’s Account is 100 SEK (appr 10 Euro). In case a transfer is initially accepted and thus shown on the Player’s Account and Gaming Operator later receives notice from the card issuer that the transfer for any reason shall be reversed, Gaming Operator will temporarily Close the Player’s Account on suspicion of fraud or stolen credit card.

Social Responsibility and Self Protection

The Player and Gaming Operator are aware of the risks of excessive gambling. In order to minimize these risks the Player is able to voluntarily put limits on the Player's gaming in the following ways ("Gaming Limitations"):

(a)      Set a limit of the time during which the Player is allowed to play during a certain session.

(b)      Set a limit on the total amount the Players may wager during a certain time period.

(c)      Set a limit on the total losses the Player is allowed to incur during a certain time period.

(d)      Set a limit on the amount that the Players is allowed to deposit into the Player's account per week.

(e)      Blocking of the Player's Account. A blocking of the account will remain effective for a period of 90 days and the account cannot be opened again until this 90 day period has elapsed even if the Player wishes to do so. The Player is also able to block the Player's Account for an indefinite period of time.

The above Gaming Limitations are carried out by contacting Customer Service at the Site (Customer Service/Contact Us/Select Topic/Limits) or in writing. A requested Gaming Limitation will have effect immediately when a confirmation email from Customer Service is received by the Player. The same procedure is used in case a prior Gaming Limitation is lowered. The Player is required to follow the Gaming Operator's instructions for implementing a Gaming Limitation. If a Gaming Limitation is raised or lifted, such change will have effect seven days after the Gaming Operator's receipt of the request. A Gaming Limitation set by the Player will remain in effect until the Player has revoked or changed such limitation. The Gaming Operator will not accept wagers in contradiction to the Gaming Limitations set by the Player.

Pay-outs

The Player always has access to its deposits and winnings (subject to the bonus money turn-over requirements set forth below) and may at any time request a payout from its Player’s Account however not more than once a week. Gaming Operator will execute payouts within three bank days. The minimum amount of a single payout is 150 SEK (appr 15 EUR) and the maximum amount is 20,000 SEK (appr 2,000 EUR). In case of amounts in excess of 20,000 SEK (appr 2,000 EUR), the Gaming Operator will request additional verification of identity from the Player in order to verify the Player's identity, age and place of residence. The Gaming Operator also reserves the right to perform such verification procedures in connection with payouts where the amount corresponds to less than 20,000 SEK (appr 2,000 EUR). In case the Player wants to withdraw a smaller amount than 150 SEK (appr 15 EUR) and/or more than one time per week, Gaming Operator shall be entitled to charge a fee of 30 SEK (appr 3 EUR) from the balance of the Player’s Account. If a Player Terminates the Player’s Account, all funds (except bonus money) will be transferred to the bank account designated by the Player.

Gaming Operator actively endeavors to combat money-laundering. Payouts from a Player’s Account to the Player will be made to the account from which the transfer, to the extent considered possible by the Gaming Operator, under the instructions and in accordance with the choices of withdrawal method provided by the Player to the Gaming Operator. The Gaming Operator, however, reserves the right to, at all times, make the final decision on the choice of withdrawal method. Depending in the Player's or the Gaming Operator's choice of withdrawal method withdrawals may result in fees payable to a third party, such as i.e. banks and financial institutes. Information on at all time's applicable fees is provided in the Site under "My Account" and "Settings". The Player understands and accepts that such fees and other fees payable to third parties shall be paid by the Player. In case a bank account has not been designated by the Player, the Player will be required to fax a copy of the Player’s identification documents to Gaming Operator and notify Gaming Operator of the bank account to which payment shall be made. An electronic form for such notification is available on the Site. Deposits made to a Player’s Account must be used as wagers in games on the Site.

Before any payouts are carried out the Gaming Operator have the right to request a valid document of identification, for example a copy of a passport, drivers license or any other valid document of identification. The Gaming Operator reserves the rights to, in its sole discretion, determine which documents of identifications that is acceptable. If the Player has deposited funds with credit cards or debit cards or if the Player has requested a payout to be made to a credit cart or debit card, the Gaming Operator has the right to request copies of both front page and back page of the document of identification. For the Players own safety, the Gaming Operator recommends that the Player only makes the first six (6) numbers and the last four (4) numbers on the credit card or debit card visible when providing the copy of the card. CVV/CVV2 on the credit card or debit card should not be visible on the copy.

Gaming Operator reserves the right to refuse pay-outs from the Player’s Account and to suspend a Player’s Account if this is not used for wagers on the Site and/or if there is suspicion of abuse of the Gaming Operator services, fraud or any other criminal act.

 

Bonuses and freespins

Gaming Operator will from time to time award bonus money to Players which are accounted for separately. Gaming Operator reserves the right to refuse or rescind bonuses at any time for any reason. Bonus money cannot under any circumstance be withdrawn from the Player’s Account. If a Player withdraws money from its Player' Account and there still is bonus money on the Player's Account has which has not been wagered in accordance with Section 2.16, such un-wagered bonus money on the Player's Account will be automatically forfeited and no longer available for the Player. The Gaming Operator applies the principle that cash funds on the Player's Account are first used for payment of games provided and Bonuses in second hand.

Bonus money must be wagered by the Player a certain number of times before any winnings resulting from the bonus money can be withdrawn from the Player’s Account. This so-called turnover requirement is normally 10 times for bingo and 35 times for casino games (including slots and Mini Games), unless otherwise stated for a specific game in connection with each respective bonus offering. Wagers on Black Jack and Roulette are, however, not included in the calculation of the Player’s bonus turn-over. The Player is responsible for ensuring that the Player is aware of the terms and conditions hereof at all times.

Any Bonuses and/or freespins may only be used on a single occasion per Gaming Account. It is not allowed in any way for a Player to use another Account in order to circumvent this restriction and gain more then one (1) bonus/freespin. The Gaming Operator reserves the right to limit bonuses and/or freespins so that they may only be used once by each household, family, address, e-mail address, IP-address and Player's Account which are used from computers in public environments (i.e. schools, workplaces and libraries). In addition, the Gaming Operator reserves the right to Close any account and take care of any existing funds if the Gaming Operator suspects that any kind of abuse, fraud or other undue usage of the Gaming Account occurs.

Winnings and Prizes

Gaming Operator will from time to time offer winnings in the form of goods instead of money. All such good have a monetary value and cannot be exchanged for money. If the Player has received winnings in the form of goods, this will be shown in the Player’s Account history. Gaming Operator will contact a Player that has won in order to verify that the address provided upon registration is correct. The Player is required to reply and confirm that the address is correct before Gaming Operator delivers the goods.

From time to time competitions will be held on the Site with different kinds of prizes (“Competition Prizes”). These competitions are completely separate from the game and any Competition Prizes will thus not be shown in the Player’s Account history. Competition Prizes have a monetary value and cannot be exchanged for money. Gaming Operator will contact a Player that has won a Competition Prize in order to verify that the address provided upon registration is correct. The Player is required to reply and confirm that the address is correct before Gaming Operator delivers the Competition Prize. Any tax levied on Competition Prizes are payable by the Player.

By accepting any winnings or prize, the Player agrees that Gaming Operator may propose to the Player to participate in PR and advertising activities. The Player will not under any circumstances be obligated to participate in such activities. In case the Player elects to participate in such activity no compensation other than the winnings or prize will be paid by Gaming Operator.

Mini Games

 

Mini Games is the name of Gaming Operator’s games in which both wagers and winnings are limited. Participation in the Mini Games may take place only when the Player is logged into the bingo system. Wagers and winnings in the Mini Games are paid from and to the Player’s Account as in the other games.

Mini Games may be created in different formats and is electronic versions of a scratch tickets, wheels and or slots. If not stated otherwise in these Terms of Use the following would apply for all Mini Games: Current payout plan is shown under the tab ”Payouts”. Prices and other information are shown under the tab ”Help”.

The Mini Game “Lotten” is an electronic scratch ticket. If a failure occurs while playing Lotten which entails that the Player cannot see the outcome or if the Player does not complete the ticket, it will remain in the system until 6 am the following day. The Player may until such time complete the ticket. If the Players does not complete the ticket before such time, the ticket will be automatically scratched by the system and the result will be found under the tabs ”My account” and ”Account History”. Winnings are automatically deposited into the Player’s Account.

Chat Rooms

No persons younger than 18 years of age are allowed in chat rooms. In the event that a minor gains access to an account held by an adult, the Player in whose name the account is registered will be held responsible for the minor's actions.

Players are required to exercise respect and maintain a friendly attitude when using the Site and participating in the chat rooms. You may not post or transmit any message, data, image or program which is libelous, defamatory, pornographic, obscene, abusive, illegal, racist, or otherwise offensive or which discloses private or personal matters concerning any person or which constitutes an infringement of any intellectual property rights or which otherwise violates any other rights of any third party. Players are barred from complaining in the chat room. All complaints must be directed to the Help Desk to prevent any disruption to the flow of the chat. Players are further barred from (a) harassing, slandering, libeling, insulting, abusing and threatening others, (b) discussing other bingo sites, advertisements, or other sites whatsoever, (c) seeking to recruit persons on behalf of other sites and (d) slander or libel of Gaming Operator’s management, employees or affiliates, or the LGA. Gaming Operator does not accept responsibility for any materials provided by players.

Soliciting other Players for money, gifts, contributions or loans is strictly prohibited. It is not allowed to discuss or announce your account balance as this may cause other Players to feel uneasy.

The above policy is for the protection of all Players and is intended to maintain a comfortable environment in our chat rooms. Should a Player not act in accordance with our policy as described herein, Gaming Operator may take any action it deems fit in order to restore a proper environment, which may entail deletion of the message and that Gaming Operator is forced to Terminate a Player’s Account.

The chat rooms are surveyed by a Chat Manager (“CM”). Players are bound to respect the Chat Manager and required to abide by the decisions of the Chat Manager.

The Player must use an alias that is in good taste and may not use an alias which is prefaced by the term “CM” or which indicates that the Player is in any way affiliated or associated with Gaming Operator. Gaming Operator reserves the right to request that a Player changes its alias at Gaming Operator’s sole discretion. Should a Player refuse to change his/her alias within a 48 hour time period, Gaming Operator shall be entitled to Close such Player’s Account pending that Player’s contacts Customer Service and changes the alias. Players can only change their alias once every 30 days, except in cases where such change is required by Gaming Operator.

All correspondence in the chat rooms is registered and may be used as evidence in relation to winners in chat games and in case of any violation of these Terms of Use.

Chat game prizes are sometimes awarded to Players participating in the chat room. Chat game prizes are offered as a way of providing additional fun and chances to win for regular Players and chatters. Chat game prizes are intended to enhance the chatters’ online gaming experience.

customer support and complaints

Support is provided and complaints are handled by Gaming Operator through an on-line help desk using the contact form at the Site (the “Customer Support”). All inquiries and complaints must be directed to the Customer Support in writing or in electronic format. A complaint shall be deemed to have been submitted in a valid manner when it contains clear information regarding the Player’s identity and gives all relevant details giving rise to the complaint. If you have submitted a help desk request you are required to allow Customer Support staff adequate time to respond to your complaint. Complaints will normally be handled by Gaming Operator within two working days from submission of the complaint by the Player. If you are not content with Gaming Operator’s handling of your complaint you may submit your complaint to Malta Lotteries and Gaming Authority at complaints@lga.org.mt

In the event that there is a discrepancy between the game variations as recorded in Gaming Operator's database, and that recorded by the Player, the calls recorded in the Gaming Operator's game server will be considered valid.

Spamming of Customer Support (sending repeated copies of the same message) is prohibited. Players are prohibited from harassing or abusing the Customer Support staff. Players are requested to address their concerns without the use of obscenities or threatening language.

Players are prohibited from discussing a complaint or the length of time within which same has been pending or has been processed by Gaming Operator in the chat rooms.

Termination and Suspension

Gaming Operator reserves the right to, at its sole discretion, Close your Player’s Account and/or the services provided by Gaming Operator with immediate effect and without prior notice. If the Gaming Operator does not suspect any breach against these Terms of Use, the Gaming Operator shall execute a payout of the Players available funds, less any third party fees, within a reasonable time after Closing. In case your Player’s Account is Closed you may no longer use the Site and/or the services provided by Gaming Operator. If your Player’s Account is Closed due to a breach of these Terms of Use, Gaming Operator shall be entitled to reclaim any winnings that have been paid out or make a set-off of winnings against the balance of the Player’s Account.

You agree to indemnify and hold harmless Gaming Operator and its officers, directors, employees, agents, licensors, suppliers and any third party content and service providers to the Site from and against all losses, expenses, damages and costs resulting from your violation of the Terms of Use.

The Player accepts and acknowledges that the Player’s Account will be automatically be classified as Dormant if there has been no transaction or activity on the Player’s Account during a consecutive period of 30 months. If an account has been classified as Dormant, the balance on the Player’s Account, minus any bonus money, will be paid out to the Player. If Gaming Operator using reasonable efforts is unable to contact the Player, the money will be forfeited and paid out to the LGA.

If the Player elects to close its Player’s Account, the Player will not be able to open a new Player’s Account until 30 days has elapsed from the date of closing.

personal data

Gaming Operator is committed to protecting your privacy and personal information. Personal and financial information of Players will be kept confidential. However, under applicable laws and gaming regulations Gaming Operator is required to maintain a secure online list of all registered Players which may be disclosed to the LGA upon request by the LGA. Hence personal data needed to identify a Player and such Player’s gaming transactions will not be deleted even if a Player’s Account is Closed, Blocked or Terminated. Gaming Operator may retain such information for the period that is required in accordance with applicable laws and gaming regulations.

For the purposes of applicable data protection legislation the Player hereby consents to the processing of any and all personal data (in manual, electronic or any other form) in connection with the Player’s transactions in relation to Gaming Operator and also marketing of Gaming Operator's services and the services of companies within the same group of companies as Gaming Operator. Gaming Operator may also transfer personal data between companies that are part of the Gaming Operator group. The Player also consents to the processing and transfer of personal data for the purposes of detecting and preventing fraud and other criminal activities in relation to Gaming Operator and other companies within the same group of companies as Gaming Operator. Gaming Operator undertakes that it shall not process any personal data relative to the Player for any purpose other than as set forth above.

Local laws and prohibitions

It is the sole responsibility of the Player to understand the laws in his/her jurisdiction of residence relating to all aspects of playing at Gaming Operator. Your access to the Site is on your own initiative and you are responsible for your compliance with local laws if and to the extent local laws are applicable. Gaming Operator makes no representation that materials on the Site or Gaming Operator's services are appropriate, available or allowed in your jurisdiction. Gaming Operator is unable to provide any legal advice regarding this matter and Gaming Operator accepts no responsibility whatsoever should an individual act in breach of any law or regulation in transacting with Gaming Operator in whichever manner.

Due to applicable laws persons who are citizens of or resident in the following countries are expressly prohibited from using the Site and playing any games provided by Gaming Operator. By registering as a Player, you confirm that you are not a citizen of or a resident in any of the following countries: United States of America (including the territories that apply US laws), Hong Kong, Turkey and Portugal.

Links

The Site may provide links or references to other websites. Gaming Operator has no particular knowledge of information contained in such other sites and does not endorse companies or products to which it links. Gaming Operator does not have any responsibility for the contents or policies of such other sites and does not accept any liability for any damages resulting from your access to or use of such other sites. If you decide to access any of the third party sites linked to the Site, you do so entirely at your own risk. Gaming Operator reserves the right to terminate any link or linking program at any time.

Intellectual Property Rights

All content on the Site, such as text, graphics, logos, button icons, images, audio clips, digital downloads and software is owned or licensed by Gaming Operator. You may not access, print and download portions of material from the Site unless expressly permitted and then solely for your personal and non-commercial use. Information on the Site may not be altered, distributed or displayed without the express consent of Gaming Operator.

Gaming Operator's trademarks, trade names and other symbols included or referenced on the Site (the "Marks") are protected by national and international trademark laws. All use of the Marks is strictly prohibited without Gaming Operator's prior written approval. The Marks may not be used in connection with any product or service that is not approved by Gaming Operator or in any manner that is likely to cause confusion among customers or that disparages or discredits Gaming Operator. The Player does not obtain any rights in relation to the Marks or any other materials on the Site. A breach of these provisions any entail liability for damages.

If you upload or post materials to the Site (including but not limited to comments, suggestions, problem reports, bug reports and design ideas) you agree that you automatically grant to Gaming Operator a non-exclusive, royalty-free, world-wide and perpetual license to use, modify, incorporate and reproduce such materials in any manner and you waive all your moral rights in relation to such materials.

Limitation of Liability and disclaimer

To the extent allowed under applicable laws, neither Gaming Operator nor any of its affiliates or content or service providers accepts any liability for any direct, indirect, special, punitive, incidental, exemplary or consequential damages of any kind arising from or relating to your access to and use of the Site and/or the services provided by Gaming Operator. In no event shall Gaming Operator's total liability to you for all damages, losses, and causes of action exceed the amount you have deposited to your Player Account during the last 90 days calculated from the date when the incident occurred.

Gaming Operator does not warrant that the Site or the services provided by Gaming Operator will be uninterrupted or error-free or that any defects will be corrected. The Site and the services are provided on an "as is" basis.

If Gaming Operator, due to a technical error in the systems that Gaming Operator licenses from its suppliers or due to any other reason outside Gaming Operator's reasonable control, makes an erroneous payment to the Player's Account, such erroneous payment shall be paid back to Gaming Operator as soon as the error has been identified. Gaming Operator shall be entitled to retake such erroneous payment without the Player's prior consent. Such erroneous payment shall be regarded as a debt to Gaming Operator until correction has been made. The Player is obligated to inform Gaming Operator immediately hereof upon becoming aware of an erroneous payment.

Amendments and Changes

Gaming Operator reserves the right to amend or change these Terms of Use at any time without prior notice to the Player. Amendments and changes enter into force when a new version of these Terms of Use are posted on the Site. The Player shall be deemed to have accepted a change of these Terms of Use in case the Player uses Gaming Operator’s services after the change has been implemented. Gaming Operator advises you to periodically review the Terms of Use in order to be informed of any changes. Gaming Operator further reserves the right to change or modify the content of the Site at any time without prior notification and will not be liable to any party in any way for possible consequences of such changes. Gaming Operator may suspend, discontinue or restrict access to any portion of the Site and/or its services at any time and without notice.

Force Majeure

Any failure or delay by Gaming Operator in the performance of its obligations of its services shall not be deemed a breach of its obligations to you if such failure or delay to the extent such failure or delay is caused by fire, flood, earthquake, elements of nature or acts of God, public utility electrical failure, acts of war, terrorism, riots, civil disorders, rebellions or revolutions, strikes, lockouts, or labor difficulties, court order, outage, delays or disruptions of the Internet or telecommunications networks, third party nonperformance or any other similar cause beyond the reasonable control of Gaming Operator. Gaming Operator does not accept any liability for the consequences arising out of any such force majeure events.

Application of the Terms of Use

These Terms of Use constitute the entire agreement between you and Gaming Operator and supersedes any and all prior and existing agreements with regards to the Site and the services provided by Gaming Operator. You acknowledge that Gaming Operator has not made any representations, promises or agreements to you relating to the subjects addressed by the Terms of Use that are not embodied herein.

Governing Law and Disputes

By accessing the Site and/or registering as a Player you agree that all matters relating to your access to and use the Site and services provided by Gaming Operator shall be governed by and construed in accordance with the laws of Malta, without giving effect to any principles of conflicts of law. Any dispute arising out of your use of the Site and/or Gaming Operator's services shall be settled by the courts of Malta and you hereby agree to submit to the exclusive jurisdiction of such courts.
